Magnify Consulting (“MC”) reserves the right to change this Privacy Policy from time to time at its sole discretion and without sending notice to you, so you should review this Privacy Policy periodically.  The effective date of this notice and any revised or changed notice may be found on this page, on the bottom left-hand corner of the notice.  Any changes will be effective only after the effective date of the change and will not affect any dispute arising prior to the effective date of the change.

What personal data we collect and why we collect it

MCs’ policy is to protect the confidentiality of the individually identifiable information that you provide, and we limit access to that information only to those with a need to know.  MC collects the following information from you:  In addition, if you choose to complete certain forms or send us requests, you will be asked to provide the following information: full name, street address, city, state ZIP, phone number, and e-mail address.

Mailing List

MC encourages all users of this Site to register for the mailing list, so that you can receive the latest information on the company (Magnify Consulting), industry updates, information on new services, etc.  You may unsubscribe at any time by clicking here.

Computer Information

MC logs your current Internet address (this is usually a temporary address assigned by your Internet service provider when you log in), the type of operating system you are using, and the type of browser software used. In addition, MC may keep track of what portions of this Site you are visiting. MC aggregates this information to help MC improve or create a better experience for users of the Site.  For example: MC may upgrade those parts of the Site that are heavily visited.

Our website automatically records website usage information that we analyze statistically to track operational problems, to prevent fraud and to improve the effectiveness, security and integrity of the site. We do not use this information to track or record information about individuals. We will disclose this information to third parties only in aggregate form or as may be required by law. For each page that you visit, we collect and store the following technical information in what is called a web server log file:

  • Date and time of access 
  • URL address of the MC webpage visited 
  • Internet domain and IP address from which our website was accessed 
  • Type of browser and operating system used to access our site (if provided by the browser) 
  • URL address of the referring page (if provided by the browser) 
  • Completion or success status of the request for a web page or other on-line item

For the purpose of enabling better website design and a better user experience, we employ Google Analytics (a web service by Google, Inc.) to track site traffic and provide aggregate reports of how the public interacts with our website. Session cookies are employed by Google Analytics in the form of client-side JavaScript code. In utilizing this analytics service, MC maintains its existing standards in regards to the sharing and disclosure of information, security and privacy safeguards for the data, and the data retention policy, each described below. Google Analytics analyzes website usage information automatically upon visits to the MC website(s). Users who do not wish to have their visit information collected by Google Analytics may opt-out by downloading a browser extension or by disabling cookies in their browser settings. Opting-out of web measurements will still permit users to access the full MC website, with all included information and functionality.

Cookies

A cookie is a piece of information that a website sends to your computer, which is stored in a file on your computer’s hard drive.  A cookie does not tell us your individual identity unless you have chosen to provide it to us. Most cookies expire after a defined period of time.

Information Collected from Other Sources

MC may also acquire personal information from other sources who have the right to provide such information to MC. For example, MC may acquire address information from these sources to validate or update your address or to prevent fraud; demographic and lifestyle information to help MC analyze our business’s performance or improve the Services; and information about your online and offline transactions and purchases to help MC analyze or improve the Services. MC receives personal information, such as your name and email address, from business partners when you participate in joint marketing promotions, events, transactions, or similar interactions with third parties with whom MC has a joint venture or similar business relationship. The categories of sources that provide personal information to MC include consumers themselves; data analytics providers; advertising networks; social networks; data brokers; operating systems and platforms; co-branded ventures; and our affiliated and related entities. MC uses collected information consistent with this Privacy Policy and for the purposes described below.

How We Use Information

MC may collect, use, retain, share, and store personal information collected from or about you for any of the following purposes: 

  • To provide and improve the Services. MC uses your personal information – such as your address– to respond to your inquiries and provide you with requested information; and to provide and improve our customer service.  In addition, MC may use personal information to analyze and improve the performance, usage and operations of our services using internal or external software and tools; to better understand who is using the services and how; and to develop new products or services.
  • To communicate with you. For example, MC may use your personal information – such as your email address, telephone number, usernames, and other contact information – to respond to your inquiries; to provide you with information about our Services; to conduct surveys, focus groups, and promotions; to engage with you over Site features; to provide you offers by email, mail, and across other websites, mobile applications, social media, and online services as appropriate; and to otherwise communicate with you as needed or permitted to run MC’s business. 
  • To perform business reporting, analysis, and research. For example, MC may use information about your transaction history with us, and information about your use of the services to engage in reporting, analytics, and research that helps MC operate or improve our business, including but not limited to metrics measuring the performance of MC’s marketing efforts and advertisements that you may see or receive. For example, MC may use your name, contact information, and other personal information to protect the security or integrity of the services and our business; to prevent fraudulent activity; to assist law enforcement; and/or to comply with legal or regulatory obligations. MC may also use and share aggregated or de-identified personal information for any purpose. 

Information We Share

MC’s policy is to prohibit the unlawful disclosure of your personal information.  MC will not release your name or otherwise publicize the fact that you purchased goods or other information to us unless: (a) you grant MC permission to do so; or (b) MC is requested or required to do so by law. Disclosure of Information

MC may disclose personally identifiable information you provide to third parties if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:  (a) complete the sales transaction, such as providing your shipping information to our carrier; (b) comply with legal process; (c) enforce the Agreement; (d) respond to claims that any information you provide violates the rights of third parties; (e) protect the rights, property, or personal safety of MC, its users and/or the public; or (f) in relation to the sale, assignment, merger, transfer or acquisition of all or substantially all of MC’s assets or shares by a third party.  

In addition, MC may share or disclose the personal information MC collects from or about you when (i) MC notifies you or obtains your consent; (ii) when MC’s service providers need such information in order to provide a business service to MC; or (iii) or in any of the following situations:

Service Providers: MC shares your personal information with service providers used to provide business, professional, or technical support functions for MC; that help MC operate its business; and that perform other activities in support of the services or MC’s business. For example, we share your personal information with service providers who assist us with shipping your order; processing and responding to your inquiries; advertising and marketing the Services; or processing your payments. Examples include advertising networks and data analytics service providers MC uses for marketing and advertising services. MC’s service providers are authorized to use your personal information only as instructed by us and for the business services they are providing to MC.

Third parties: MC may also provide personal information to business partners or other third parties with whom MC may jointly offer products or services. In such cases, the business partner or third party’s name will appear with MC’s, and the third party’s, use of your personal information will be governed by their privacy policies. We may also share aggregated or de-identified information with third parties without restriction.

Surveys, focus groups, and promotions: If you choose to enter into or participate in one of MC’s surveys, focus groups, or other promotions, MC may disclose your personal information to third parties or the public in connection with the administration of these items, as required by law, as permitted by the official rules, or otherwise in accordance with this Privacy Policy.

Sales or transfers of businesses or assets: We may sell or purchase assets during the normal course of our business. If another entity acquires MC and/or of any of our affiliates, personal information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against MC, such information may be considered an asset of MC’s and may be sold or transferred to third parties.

Legal matters; compliance with the law: MC may disclose personal information collected from or about you to the government, insurance providers, or to other third parties to comply with applicable law; regulations; governmental and quasi-governmental requests and investigations; court orders; subpoenas or other legal processes; or to defend ourselves in legal matters. MC may share your personal information with fraud prevention service providers in connection with suspected illegal activity associated with any of the Sites or our business; to protect against harm to the services, to MC, or to others; to detect security incidents; or to defend ourselves in legal matters.

Tracking

Because we link to social media sites, and from time to time may include third-party advertisements, other parties may collect your personally identifiable information about your online activities over time and across different web sites when you visit this Site.

In addition, we use Google AdWords, so we are advertising the Site online through a form of tracking called remarketing,  Third-party vendors, including Google, show our ads on various sites across the Internet, and use cookies to serve you ads based on your past visits to this Site.  You can opt out of Google’s use of cookies by visiting Google’s Ads Settings https://www.google.com/settings/ads/plugin . Please note that not all tracking will stop even if you delete cookies.

Encryption

MC uses no encryption (data scrambling) on certain portions of the Site, but uses encryption on portions where you are transmitting financial information, such as credit card information. When you are on any web site that asks you for confidential information, you should check to see if the information being transmitted is encrypted in order to increase the security of your information.  Keep in mind that there is no such thing as perfect security.

Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL MC BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT MAY ARISE FROM A CLAIM OF BREACH OF THIS PRIVACY POLICY.  Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law, or $5, whichever is less.

Process for Review and Changes

Given the limited information collected and the form in which MC receives it, MC does not offer a process for review and changes to personal information. 

Children and Minors

MC makes no active effort to collect personal information from children under the age of 18 and does not wish to receive any such information.
